ELEVATED OATS GROUP HIKE LIABILITY RELEASE WAIVER
I, the undersigned, in consideration of my participation in Elevated Oats group hikes (the “Event”), acknowledge and agree as follows:

Risk Acknowledgement: I understand that participation in the Event involves inherent risks and dangers of accidents, rescue operations, emergency treatment, property loss or damage, serious personal and bodily injury, death, and severe personal and economic losses. These may result not only from my own actions, inactions, or negligence, but also from the actions, inactions, or negligence of others, or the condition of the facilities, equipment, or areas where the Event is being conducted.

Assumption of Risk: Knowing the risks described above, I voluntarily and willingly assume all risks and dangers associated with my participation in the Event. I take full responsibility for any injury or loss, including death, which I may suffer, arising in whole or in part out of my participation in the Event.

Release and Indemnity: I hereby release and promise not to sue, and I will indemnify, defend and hold harmless, Elevated Oats, its employees, volunteers, hike leaders, officers, directors, agents, representatives, and affiliated organizations (collectively “Elevated Oats Parties”) from any and all rights and claims including claims arising from the Elevated Oats Parties’ own negligence, which I have or which may hereafter accrue in connection with my participation in the Event.

Consent to Medical Treatment: I authorize Elevated Oats Parties to provide to me, through medical personnel of their choice, customary medical assistance, transportation, and emergency medical services. This consent does not impose a duty upon Elevated Oats Parties to provide such assistance, transportation, or services.

Severability: If any provision (or part of any provision) of this Agreement is found to be illegal, invalid or unenforceable under any applicable law, such term shall, insofar as it is severable from the remaining terms, be deemed omitted from this Agreement and shall in no way affect the legality, validity or enforceability of the remaining terms.

Venue and Jurisdiction: This Agreement shall be construed and enforced according to the laws of the State of Alaska and any dispute under this Agreement must be brought in this venue and jurisdiction.
By registering for an Event, I acknowledge that I have read and understand this agreement and I am aware that by signing this agreement I am waiving certain legal rights, including the right to sue.
